The CLE curriculum will include a review of the various issues involved when cars, kids and CPS collide:

 

    • Brief Review of Crimes Related to Children
      Attorneys Lizanne Padula and Lauren McLane will review the various offenses relating to unattended children in vehicles, custodial interference, abandonment of a dependent, DUIs with children in a vehicle, reckless endangerment of children and many more.

 

    • Once Law Enforcement Has a Parent in Custody, What is DSHS/CPS’s Reaction?
      Teresa Sach, formerly with DSHS DCFS and now an assessor for the US Army on Domestic Violence and Child Abuse cases, will review the process from first call to the final letter in a CPS/DSHS investigation, presenting two hypotheticals including (1) leaving a child in a car unattended, and (2) a DUI with a child in the car.

 

  • Ethics of Interacting with DSHS/CPS and/or Dependency Attorney
    Attorney Lorraine Roberts of the King County Public Defenders Office will review the ethical implications and dilemmas in the interplay and cross over between criminal charges and DSHS Administrative actions focusing on the ethical obligations of criminal defense attorneys when kids and CPS are involved.

This CLE has been approved by the WSBA for 3 CLE credits including 1 Ethics credit.

This CLE is free to CJE members. Cost is $100 for attorneys not a member of CJE.

Citizens for Judicial Excellence is conducting the second in a series of Continuing Legal Education courses on June 19, 2015, from 12:00 pm to 3:00 pm. The CLE will be held at Regus Center, Carillon Point, Kirkland.

The CLE curriculum will include a review of financial responsibility requirements including SR22 insurance and bonds:

      • SR 22 Insurance From the Insurance Company’s Perspective
        Joe Klein, Everett Branch Manager and an Agent with Vern Fonk Insurance, will discuss SR 22 Insurance, i.e. insurance required under RCW 46.29, from the insurance company’s perspective. What does the insurance company do? How do they do it? How do they communicate with DOL? What information is provided? How are rates determined?
      • Alternate Methods of Giving Proof of Financial Responsibility
        Diego Vargas, owner of The Vargas Law Firm, will speak on the alternate methods of giving proof of financial responsibility for the future under RCW 46.29. These methods include: bonds as provided in RCW 46.29.520; certificates of deposit of money or securities as provided in RCW 46.29.550; and certificates of self-insurance, as provided in RCW 46.29.630.
      • Information About Legal Services – Advertising and Social Media
        Diego Vargas will speak on the Rules of Professional Conduct as they relate to communicating information about legal services. This discussion will include advertising and social media.

2015 Annual Meeting Report: Barr Retires, Padula Elected President

Steve-Ted-Award-PresentationThe 2015 Annual Meeting of Citizens for Judicial Excellence was held on March 19 in Kirkland. Ted Barr, CJE President for the past eight years, retired and the membership elected Lizanne Padula as CJE President for the next four-year term.

Founding member Steve Hayne presented Ted with an award recognizing his eight years of service to CJE and his role as founding CJE president who built CJE into the respected and effective organization it is today.

Out-going Treasurer Mark Garka’s  presentation showed CJE to be in good financial health and already building its war chest for the 2018 elections.

The membership was briefed on CJE’s on-going series of continuing legal education courses for members and interested attorneys and the variety of social events held each year. Barr noted that Poker Night is coming up on May 2 and looks to be the biggest and best fundraising event yet.

Citizens for Judicial Excellence presents another CLE in its series of Continuing Legal Education courses on April 17, 2015, from 12:00 pm to 4:00 pm. The CLE will be held at the Kirkland Justice Center & City Jail in Kirkland, WA.

Course Description:

The CLE curriculum will feature a review of the City of Kirkland incarceration policies, work release programs and EHM, including a tour of the Kirkland City Jail. The ethics portion of the CLE is titled “Understanding Confidentiality Of Information And The Duty Of Candor To The Tribunal.”

All CJE members are invited and encouraged to attend the 2015 Annual Meeting of Citizens for Judicial Excellence. This meeting is one of the more important meetings for CJE members as elections will be held for officers to serve for the next four years.

The CJE Board will review CJE’s financial status, accomplishments during 2014, and goals for 2015 and beyond as we plan for the 2018 municipal and district court elections.

The meeting will include a discussion about indentifing promising judicial candidates and building a farm team of pro tems who will be well-prepared to run for office in 2018. There are likely to be a significant number of open seats in 2018 as well as vacancies that will open to be filled by King and Snohomish county councils.

All members are encouraged to attend and share ideas on races where CJE might play an important role, discuss potential judicial candidates, and “fact check” any rumors that might be floating around out there. As usual, the annual meeting will include a straw poll and discussion of the results which will help guide the organization’s leadership in the coming year.

The meeting commences on Thursday, March 19, 2015, at 5:30 p.m. at Carillon Point (same location as last year’s annual meeting) located at Carillon Point Regus Center, 5400 Carillon Point, Building 5000, 4th Floor in Kirkland. Parking is located directly across the driveway from Building 5000 and is free for those departing after 7:00 p.m.

The CJE Board and Political Directors will review the field of candidates for municipal and district court judicial races in King, Snohomish and Pierce counties.

All members are encouraged to attend, share their thoughts on races where CJE should play an important role, discuss declared or potential judicial candidates, and vote on which candidates CJE should target or support. This meeting will include a poll of candidates and discussion of the results which will help guide the organization’s leadership in the coming elections.

CJE’s political directors, Dia Armenta and Dean Nielsen, will be at the meeting to answer questions and provide an opportunity to gain insight on the judicial political landscape for 2014.

The meeting commences on Thursday, May 1, 2014, at 5:30 p.m. at Carillon Point (same location as the January annual meeting) located at Carillon Point Regus Center, 5400 Carillon Point, Building 5000, 4th Floor in Kirkland. Course Description:

Conditions of release, Bail, EHM, Transdermal Alcohol Monitoring, and the ethical implications of bail hearings will be explored during a three hour presentation sponsored by CJE.

Denny or Gayle Behrend of Lacey O’Malley Bail Bonds will review and explain the complicated process and rules governing the posting of bail and riders in criminal cases.

Fidelis Leasiolagi of 2 Watch Monitoring will explain the ins and outs of EHM and Transdermal Alcohol Monitoring.  Fidelis will bring actual working equipment so participants can see how the equipment works.

Diego J. Vargas will then discuss the ethical implications of bail hearings and how to handle them.

CJE ATA CLE on DUI Assessments

Assessment & Treatment Associates is conducting a CLE for CJE members on DUI Assessments. The CLE will be held at Regus Center, Carillon Point, Kirkland on November 15 from 12:00 to 5:00 p.m. with a complimentary lunch provided by ATA.

The presentation will include a brief history of chemical dependency assessments in Washington State as it relates to court referred patients. ATA will discuss the following topics:

  • Progression from vague diagnostic categories developed by a Department of Licensing and DSHS Joint Commission to the implementation of the use the Diagnostic and Statistical Manual (DSM) and it’s specific criteria for diagnosing substance related conditions. This will include the recent elimination of the distinction between substance abuse and substance dependence and the merging of their criteria into one category title Substance Use Disorder with the severity of the disorder determined by the number of criteria met.
  • The removal of “recurrent sub- stance-related legal problems” as a criterion.
  • The transition away from set length programs to the required use of ASAM Patient Placement Criteria for objectively determining appropri- ate level of care and ongoing length ofstayintreatment.Itisoftenmisun- derstood that the treatment indicated in an assessment letter is only an es- timate and actual length must be de- termined by progress with only two exceptions, that is, for mandatory minimum programs subject to RCW 10.05 or RCW 46.61.5056.
  • A discussion of the additional requirements for DUI Assessments un- der WAC 388-877B-0550 as well as a demonstration of the CD assessment process.
